The IMSCLUB.com website (the “Site”) is composed of various web pages operated by IMS CLUB.  IMSCLUB.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of IMSCLUB.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.  IMSCLUB.com is an E-Commerce Site.  For business to get the best value for corporate travel. As well as for our property owners to rent out their unused time. We connect the business and property owners.

Certain services made available via IMSCLUB.com are delivered by third party sites and organizations. If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that IMS CLUB is not responsible for third party access to your account that results from theft or misappropriation of your account. IMS CLUB and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

International Users

The Service is controlled, operated and administered by IMS CLUB from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the IMS CLUB content accessed through IMSCLUB.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Indemnification

You agree to indemnify, defend and hold harmless Affiniti Marketing Group Inc, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Affiniti Marketing Group Inc reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Affiniti Marketing Group Inc in asserting any available defenses.

Refusal of Service IMS CLUB Membership Refund/Cancellation Policy (Affiniti Marketing Group, INC) reserves the right to refuse/cancel a membership in the IMS CLUB. IMS CLUB refuses a new or renewing membership, registrants will be offered a refund.  Membership Cancellation by Participant  Membership cancellations received within 10 days of registration may be eligible to receive a full refund less $50 service fee. Cancellations received after the stated deadline Florida Statute 721.205 will not be eligible for a refund.  

How do I Cancel?

Cancellations will be accepted via phone or email, and must be received by the stated cancellation deadline. All benefits and incentives received by participants must be canceled. All refund requests must be made by the attendee or credit card holder. Refund requests must include the name of the attendee and/or transaction number. Refunds will be credited back to the original credit card used for payment. These above policies apply to all IMS CLUB  memberships unless otherwise noted in the corresponding program materials. Please read all individual program information thoroughly.  

When do I get my Refund ?

Your refund will be made within 20 days after receipt of notice of cancellation or within 5 days after receipt of funds from your cleared check, whichever is later.

Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and IMS CLUB agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.
